Terms of Service

1. Agreement to terms

By accessing or using MotifLoom ("the Service"), operated by Alperen Eser ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. These terms constitute a legally binding agreement between you and MotifLoom.

2. Eligibility

• You must be at least 16 years old to create an account (in compliance with GDPR). Users under 16 may not use the Service.
• If you are between 16 and 18, you represent that your parent or legal guardian has reviewed and agreed to these terms.
• You must provide accurate and complete registration information.
• You may not use the Service if you have been previously banned or suspended.

3. Your account

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• One person per account. Automated account creation is prohibited.
• You must notify us immediately at security@motifloom.com if you suspect unauthorized access.
• We reserve the right to reclaim usernames that are inactive for more than 12 months or that infringe trademarks.

4. Your content

• Ownership: You retain all rights to content you create on MotifLoom. We do not claim ownership of your motifs, nodes, notes, or any other user-generated content.
• License to us: By making content public, you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and reproduce that content solely for the purpose of operating the Service (e.g., showing it on the Explore page, generating OG previews).
• License to other users: Public motifs can be viewed and forked by other users. When you fork a motif, you create an independent copy — the original author retains their rights.
• Private content: Private motifs are only accessible to you. We do not access, read, or analyze private content except as required by law or to investigate abuse reports.
• Responsibility: You are solely responsible for the content you upload. Do not upload content that is illegal, infringing, defamatory, harassing, or harmful.

5. Acceptable use

You agree not to:

• Use the Service for any illegal purpose or in violation of any applicable law.
• Upload content that infringes intellectual property rights of others.
• Harass, abuse, threaten, or intimidate other users.
• Impersonate any person or entity.
• Use automated means (bots, scrapers, crawlers) to access the Service without written permission.
• Attempt to gain unauthorized access to other accounts or our systems.
• Interfere with or disrupt the Service or servers.
• Use the Service to distribute spam, malware, or phishing content.
• Circumvent rate limits or security measures.
• Resell or commercially exploit the Service without authorization.

6. Intellectual property

The MotifLoom name, logo, design, and underlying technology are our intellectual property. You may not copy, modify, or distribute our branding or source code without written permission. The Service's visual design, UI components, and documentation are protected by copyright.

7. Third-party content and services

The Service integrates with third-party APIs (TMDB, RAWG, Open Library, ListenNotes) to fetch metadata. This metadata is provided by those services and subject to their respective terms. We are not responsible for the accuracy or availability of third-party content. Links added by users point to external websites we do not control.

8. Service availability and modifications

• We strive for high availability but do not guarantee uninterrupted or error-free access.
• We may modify, suspend, or discontinue features with reasonable notice (14 days for material changes).
• Scheduled maintenance will be communicated in advance when possible.
• We are not liable for any loss resulting from service interruptions.

9. Termination

• By you: You may delete your account at any time through Settings. All associated data will be permanently removed within 30 days.
• By us: We may suspend or terminate accounts that violate these terms, with notice where practicable. In cases of severe abuse (spam, illegal content, security threats), we may act immediately without notice.
• Effect: Upon termination, your right to use the Service ceases. Sections 4, 6, 10, 11, and 12 survive termination.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MOTIFLOOM, ITS OPERATOR, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR €100, WHICHEVER IS GREATER.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify and hold harmless MotifLoom and its operator from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these terms.

13. Governing law and disputes

• For EU/EEA users: These terms are governed by the laws of the Republic of Turkey. However, mandatory consumer protection laws of your country of residence apply where they provide greater protection. You may bring claims in the courts of your country of residence.
• For US users: These terms are governed by the laws of the Republic of Turkey. Any disputes shall be resolved through binding arbitration in accordance with applicable rules, except that you may bring claims in small claims court if eligible. You waive the right to participate in class actions.
• For all users: Before initiating formal proceedings, you agree to attempt resolution by contacting us at legal@motifloom.com. We will attempt to resolve disputes within 30 days.

14. DMCA and copyright

We respect intellectual property rights. If you believe content on MotifLoom infringes your copyright, send a DMCA takedown notice to legal@motifloom.com including:

• Identification of the copyrighted work.
• Identification of the infringing material and its location on the Service.
• Your contact information.
• A statement of good faith belief that the use is not authorized.
• A statement under penalty of perjury that the information is accurate.
• Your physical or electronic signature.

15. Changes to these terms

We may update these terms from time to time. Material changes will be communicated via email to registered users at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance. If you disagree with changes, you may delete your account before they take effect.

16. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
